The claimant was a long leaseholder of a flat. In April 2004, the claimant had been provided with contact details for both the freeholder and his agent. In August 2004, the claimant’s solicitors wrote to the defendant’s agent in relation to dilapidations at the property. The letter was copied to the freeholder at the address he had given in April 2004.
